Article 1: General provisions

The e-commerce website of Miamor (= Giselda Marku), a one-person business with its registered office at Budastraat 12, box 2.1, 8500 Kortrijk, VAT BE 0733 893 090, offers its customers the opportunity to purchase the products in its webshop online.

These General Terms and Conditions apply to any order placed by a visitor to this e-commerce website. When placing an order through the webshop of Miamor (= Giselda Marku), the customer must expressly accept these terms and conditions, agreeing to the applicability of these terms and conditions to the exclusion of all other terms and conditions. Additional conditions of the customer are excluded, except when previously, in writing and expressly accepted by Miamor (= Giselda Marku).

Article 2: Price

All prices stated are in EURO and always include VAT and all other compulsory charges or taxes to be borne by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.

The price stated refers exclusively to the articles as described word for word. The accompanying photos are for decorative purposes only and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are composed with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not legally bind Miamor (= Giselda Marku). Miamor (= Giselda Marku) is regarding the accuracy and completeness of the information offered only held to a means obligation. Miamor (= Giselda Marku) is not liable for obvious material errors, misprints or printing errors.

Article 4: Online purchases

Miamor (= Giselda Marku) is entitled to refuse an order due to a serious shortcoming of the customer regarding orders involving the customer.

Article 5: Delivery and execution of the agreement

The delivery is made by Bpost.

Any visible damage and/or qualitative shortcomings of an article or other shortcomings in the delivery must be reported immediately by the customer, within 10 working days, via mail to [email protected].

The risk of loss or damage shall pass to the customer as soon as he (or a third party designated by him and other than the carrier) takes physical possession of the goods. However, the risk is already transferred to the customer upon delivery to the carrier, if the carrier was commissioned by the customer to transport the goods and this choice was not offered by Miamor (= Giselda Marku).

Article 6: Right of withdrawal

The customer has the right to withdraw from the contract within a period of 14 calendar days without giving any reason by sending an email to [email protected].
The customer must return the goods or hand them over in the store without delay and in any event not later than 14 calendar days from the day he communicated his decision to withdraw from the contract to Miamor (= Giselda Marku), this maximum in the period of 24 hours after receipt of the goods reported by mail [email protected]. The customer is on time if he returns the goods before the period of 14 calendar days has expired.
The direct cost of returning the goods shall be borne by the customer.

If the returned product is in any way impaired in value, Miamor (= Giselda Marku) reserves the right to hold the customer liable and claim compensation for any impairment of the value of the goods resulting from the customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items in their original packaging, unworn and undamaged with proof of purchase can be returned. Purchases made during sales are not taken back nor exchanged nor refunded.

If the customer withdraws from the contract, Miamor (= Giselda Marku) will refund all payments received from the customer up to that point, including the standard delivery costs, within a maximum of 14 calendar days of Miamor (= Giselda Marku) being informed of the customer's decision to withdraw from the contract. In the case of sales contracts, Miamor (= Giselda Marku) may wait to refund until it has recovered all the goods.
Any additional costs resulting from the customer's choice of a mode of delivery other than the cheapest standard delivery offered by Miamor (= Giselda Marku) will not be refunded.

If the customer has specific questions about e.g. sizes, color, availability, delivery time or delivery method, we request the customer to contact us in advance via e-mail to [email protected].

The offer is always valid while stocks last and can be modified or withdrawn by Miamor (= Giselda Marku) at any time. Miamor (= Giselda Marku) can not be held responsible for the unavailability of a product. If an offer has a limited validity or is made under conditions, this will be explicitly mentioned in the offer.

Article 7: Penalties for non-payment

Without prejudice to the exercise of other rights held by Miamor (= Giselda Marku), in the event of non-payment or late payment, the customer shall be liable, automatically and without warning, to interest of 10% per annum on the unpaid amount from the date of the default. In addition, the customer shall be liable, ipso jure and without warning, to a lump sum compensation of 10% on the amount involved, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Miamor (= Giselda Marku) reserves the right to take back the items not (fully) paid for.

Article 8: Invalidity - non-waivers

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this will in no way affect the validity, legality and applicability of the other provisions.

The failure at any time by Miamor (= Giselda Marku) to enforce any of the rights enumerated in these conditions, or to exercise any of them, will never be seen as a waiver of such provision and will never affect the validity of these rights.

Article 9: Amendment of terms and conditions

These Terms and Conditions are supplemented by other conditions where explicitly referred to, and the general sales conditions of Miamor (= Giselda Marku). In case of contradiction, these conditions prevail.
